What Are Employees’ Rights When It Comes to Workers’ Compensation?

Understanding your rights under workers’ compensation is vital, especially after you experience a workplace injury. Knowing your rights will make it easier as you go through the process of filing a claim because then you know exactly what’s expected of you and what you need to do to ensure coverage.

Medical Practitioners and Second Opinions

You have the right to choose your medical practitioner, but you must notify your employer of your choice prior to treatment (or as soon as reasonably possible after treatment). Emergency room treatment does not count as your choice. If you want to change medical practitioners, you must get written permission from your employer or the insurer.

You may have the right to receive benefits.

You may receive benefits regardless of who was at fault for your injury with certain exceptions, such as:

· You were intoxicated at the time of the injury;

· You injured yourself on purpose or while trying to injure someone else;

· You were injured by another person for personal reasons;

· You were injured by an act of God;

You have the right to hire an attorney at any time to help you with your claim.
